한나라당의 언론악법 날치기 처리에 대한 논평(2009.7.22)

언론악법 날치기, 원천무효다
환란이다. 이명박 정권과 한나라당이 끝끝내 언론악법을 밀어붙여 환란을 자초했다. 민주주의의 근간인 언론마저 장악하기 위해 국민의 다수가, 전문가인 언론학자와 현업 언론인 대다수가 반대하는 언론악법을 만들려는 정부·한나라당은 어느 나라 정부이며, 어느 나라 정당인가? 국민이 대통령과 의원으로 뽑아주었다고 민주주의를 파괴하는 것까지 용인한다는 억지를 부리는 것인가?
미디어 구조의 지각변동을 불러일으킬 법안을 제출하고 채 한 달도 안 되는 기간에 통과시키겠다고 협박하더니, 아무 권한도 없는 미디어발전국민위원회를 구성해서 사회적 논의를 하는 체했다. 그러나 한나라당은 자당 추천위원들을 앞세워 원래 취지인 국민여론수렴은 하지 않은 채 시간을 끌며 명분 쌓기만 하더니 이제 완전히 본색을 드러냈다. 국민의 60～70%가 수많은 여론조사를 통해서 일관되게 반대의사를 표명해온 방송법 등 언론 악법을 직권 상정하여 국회의장도 참석하지 않은 채 날치기 통과를 시도한 것이다.
한나라당은 ‘날치기’라는 반민주적 폭거를 서슴없이 저질러 놓고 언론악법이 통과되었다고 주장하고 있다. 하지만 국회법 제113조(표결결과 선포)에는 표결이 끝났을 때에는 의장은 그 결과를 의장석에서 선포한다고 분명히 되어 있다. 재적의석 145석인 시점에서 표결은 종료되었고 전광판마저 꺼졌다. 재적과반 148석에 미치지 못하여 부결된 것이다. 이로써 방송악법은 자동폐기 되었다. 법 제 92조에는 부결된 안건은 같은 회기 중에 다시 발의 또는 제출하지 못한다고 하는 일사부재의의 원칙을 규정하고 있다. 표결이 종료되어 부결된 안건을 재투표에 부친 것은 명백한 국회법 위반이다. 더구나 대리투표 의혹마저 제기되고 있는 실정이다.
만약 한나라당이 날치기 통과시도를 넘어서서 국회법마저 무시하고, 꼼수를 부려 방송악법이 통과됐다고 우긴다면 이명박 정권과 한나라당은 국민적 저항에 부딪쳐 파국을 면치 못할 것이다. 폭거에 항거하고 있는 민주당, 민주노동당, 창조한국당, 진보신당 등 야당과 총파업에 임한 진정한 언론인들과 함께 온 국민이 민주주의 파괴책동을 단죄하고 분쇄할 것임을 천명한다.

한나라당에 경고한다. 이제 언론악법 중 핵심인 방송법이 무리한 직권상정으로도 부결되었으니 더 이상의 미련을 버려라. 신문법 등 악법도 원천 무효화하라. 그리고 언론악법을 강행하려고 국민을 속이고 나라를 혼란케 한데 대해, 국민들에게 엎드려 사죄하고 거짓 민생정치가 아닌 참된 민생정치를 하도록 하라. 그렇지 않으면 직권상정의 폭거를 허탈하게 지켜봐야 했던 국민의 분노가 이제는 그저 말로만 그치지 않을 것이다. <끝>

*영문성명서The Vicious Media Bills Forcefully Got Through by the Snatchers Are Totally Invalid
Now, we came to a crisis. It is a crisis brought by none other than the MB administration and the Grand National Party(GNP). They have rushed the vicious media bills through by force at last. They are daring enough to pass such vicious bills that not only the majority of the people but also of the media experts and journalists are opposing? For what government and what country are the MB administration and the ruling GNP working? Do they think that they are duly given the right to destroy democracy, just because they were elected by the people?
At first, they threatened to pass the media bills within a month after having submitted it, and then pretended to put them through public discussions by organizing a media committeea titular committee with no authority. Then, the GNP kept stalling for time with no substantial effort to probe public opinion and finally, they revealed their shameless face and, though 60~70% of the people in countless surveys had opposed constantly, they brought the vicious bills to the floor vote and, even with the Chairperson absent, snatched them through by force.
Despite their anti-democratic snatch, the GNP has even insisted on the successful passage of the bills. However, the Article 113 of the National Assembly Law with regard to the proclamation of voting results) clearly specifies that after a voting, the Chairperson should proclaim the result from the chair. In fact, the voting was ended and the electric bulletin board was off when the number of seats on the register was 145. The broadcasting bill was thereby automatically abandoned because the number failed to meet the required quorum of 147 seats. As the Article 92 says writes that it is not permissible to propose or submit the once denied bill at the same session, they violated the principle of 'ne bis in idem'. It is an obvious violation of the National Assembly Law to take a re-vote on the case on which a voting was done. Furthermore, doubts were raised that some ballots were cast by other lawmakers.
If the MB administration and the GNP close their eyes to their atrocities and insist on the passage of the vicious media bills, they will not avoid facing a catastrophical resistance of the people. All the people, together with all the opposition parties such as the Democratic Party, the Democratic Labor Party, the Renewal of Korea Party, the New Progressive Party, and all the sincere journalists now on general strike, will be out to punish and crush those anti-democratic destructions of democracy by the MB administration and GNP.
We warn the GNP of this: Give up the vicious broadcasting bill as it was denied, and nullify the vicious revisions including the newspaper bill. And kneel down and make a humble apology for your lying and making a havoc of the nation. Turn your attention to better people's livelihood, instead of pretending to work for them. Otherwise, the anger of the frustrated people watching the bills pass the floor by force will not be calmed down only with words of protest. <end>
